Massachusetts personal injury settlements

What is a settlement?

In a civil suit, such as a personal injury lawsuit, a settlement is an agreement reached between the plaintiff (the person bringing the lawsuit) and the defendant (the person or parties being sued) in a lawsuit.  The agreement allows the parties involved to discontinue the lawsuit and to, as it is often referred, "settle of out of court."  A personal injury settlement in Massachusetts is always a written agreement, signed by both parties to the suit.

Two common elements of a Massachusetts injury settlement are—

  • A payout agreement (how much money the defendant agrees to pay to the plaintiff)
  • A clause that removes the defendant's further obligations

An out-of-court settlement may occur before your case ever reaches a trial, or your case may already be in progress when the defendant offers of settlement terms that are sufficient for a fair settlement.  The court enforces the settlement

Why settle?

It is most often deemed by both parties in a trial to end the dispute without a trial.  There are several reasons for this.

  • A court trial can be very time-consuming and expensive.
  • The expense of continuing outweighs the expected award from a trial.
  • A trial can be very emotionally and psychologically stressful.
  • Either party may have difficulty in finding expert witnesses for the trial.
  • Either party may want to avoid the publicity of a trial.
  • Settling removes the risk of going to trial and ten losing.
  • The defendant can avoid admitting fault by settling.
  • A party discovers weaknesses in their evidence

If a fair Massachusetts personal injury settlement is offered by one party, it is often in the best interest of both parties to agree to the settlement and discontinue the lawsuit.
