A recent example of MULTIPLE CLAIMS arising from ONE ACCIDENT is when our client, a construction supervisor, tripped and fell in a hole at his job site, suffering a twist injury to his knee.
The FIRST CLAIM we won for him was the fight to get him appropriate workers compensation weekly wage payments and medical treatment. As a result, the client was able to receive his immediate surgical treatment at a top hospital, while at the same time receive his proper Nine Hundred ($900.00) dollars weekly benefits while disabled from work.
The SECOND CLAIM we represented our client for was pursuing a negligence case against the job site excavator for leaving a dangerous trench in the foundation at the job site which resulted in the client’s injury. We were able to show that the excavator violated Federal and State safety rules and was the cause of our client’s injury. As a result, we were able to obtain a settlement against the job site excavator.
The THIRD CLAIM was to obtain early monthly Social Security Disability Insurance for our client. Our client had worked his whole life paying into Social Security and therefore was qualified for a disability retirement, just as if he retired at the normal time.
The FOURTH CLAIM was to pursue widow’s benefits for our client’s widow through the workers compensation law. Our client eventually suffered a post-surgery infection and pain which resulted in his death a few years after the initial injury. Just as all the insurance companies did in this matter, the client’s workers compensation carrier refused to pay our client’s wife widow’s benefits. Widow’s benefits are available under the Massachusetts workers compensation statute when the injured suppose dies from his work injuries and leaves a surviving spouse. We fought for the widow as if she were our original client. As a result, we were able to obtain a Two Hundred and Fifty Thousand ($250,000.00) dollar lump sum award as a result of her husband’s injuries.
